Florida governor signs legislation preventing specialty hospitals

Florida Gov. Jeb Bush yesterday signed into law certificate-of-need reforms backed by the
Florida Hospital Association, including a provision that prevents the licensure of niche
or specialty hospitals. Effective July 1, FHA says, the legislation will prevent a
hospital from being licensed or re-licensed if 65% or more of its discharges in the most
recent year were for cardiac, orthopedic or cancer-related diseases and disorders, or if
it restricted its medical and surgical services to primarily or exclusively cardiac,
orthopedic, surgical, or oncology specialties. Existing hospitals are grandfathered from
the prohibition as long as they maintain the same ownership, street address and range of
services. The legislation also eliminates certificates of need for adult open-heart
programs and burn units, and for additional acute care, mental health or neonatal
intensive care unit beds at existing hospitals.
