AAEM MEETS WITH CMS REGARDING ACCESS TO BILLINGS

As you are aware, for the last seven years AAEM has worked diligently on behalf of
emergency physicians regarding access to billings made in their name.  As part of our
ongoing efforts, Board Member Robert M. McNamara, MD, and AAEM's Director of Government
Affairs, Kathleen Ream, met on July 6, with the lead CMS officials in Washington, D.C.,
in follow-up to the recent major activity in this area.  CMS was represented by its
Administrator, Mark McClellan and Dr. William Rogers, an emergency physician who is the
Director of CMS' Physicians Regulatory Issues Team and Staff. 

The AAEM representatives thanked the CMS team for their efforts to date, particularly the
issuance in March, 2004 of a directive to the Medicare carriers stating that physicians
who contract with an entity (i.e. a contract group) should have contractually guaranteed
"unrestricted access" to claims submitted on their behalf.  The main purpose of our
meeting was to express the Academy's view that further strengthening of this language
from "should" to "shall" would be of great benefit to practicing emergency physicians,
given their continued risk for sanctions regarding the submission of improper claims. 
The Academy will continue to work with CMS on your behalf in this matter as the issue of
access to billings progress in the near future.  Additionally, AAEM pointed out the
potential conflict between the new reassignment statutes allowing corporate entities to
receive physician payments and state prohibitions on the corporate practice of medicine. 
AAEM offered to provide CMS with assistance on this topic if there is further
investigation along those lines.
